Bill Robinson: 9th Circuit Ruling: “Brokeback is In; Bible is Out” informs us..
“In a 2-1 decision, the U.S. 9th Circuit Court of Appeals said that a T-shirt that proclaimed “Be Ashamed, Our School Embraced What God Has Condemned” on the front and “Homosexuality Is Shameful” on the back was “injurious to gay and lesbian students and interfered with their right to learn.” The court said that the shirt can be barred on a public high school campus without violating the 1st Amendment…

The two-judge majority criticized (dissenting Judge) Kozinski, suggesting that the majority could rely upon the motion pictures Brokeback Mountain or The Matthew Shepard Story as evidence of the harmful effects of anti-gay harassment…. The majority implied that Brokeback Mountain is in, and the Bible is out. What’s really broken here is the majority’s approach to the First Amendment.

Here’s what he said in vigorous support of future lacrosse-team rapist Tyler Harper: “I have considerable difficulty with giving school authorities the power to decide that only one side of a controversial topic may be discussed in the school environment because the opposing point of view is too extreme or demeaning…. The fundamental problem with the majority’s approach is that it has no anchor anywhere in the record or in the law.”

“interfered with their right to learn?” eh?
Oh…and the half naked girls who insist on wearing next to nothing to school, (citing first amendment rights of course) don’t interfere with their ahem…ability to learn?

Which legal strategy decides who is afforded “special protections” under the law?

Ahem…Actually..The history of Western civilization shows us that nearly all social and moral progress has been brought about by persons with religious convictions, not by moral relativists whose opinions fluctuate with the tides.

T-shirts demoralizing girls and women are worn routinely which puts the lie to the notion that they have any reliable “criteria” for what “harmful effects” speech has. In fact misogyny is a casual pastime of our culture. Ask any student to sing the latest rock or rap lyrics from the Top 40.

Indeed, homosexuality offers the sanctuary of political correctness, unlike misogyny which seems to fly well under their radar.

First Amendment violations are being distorted endlessly by the Liberal, socialist, Lefties. The left wingers are essentially campaigning to advance their anti-God, socialist agenda at the taxpayer expense, attacking our secular public schools as well as the rights of patriots and believers.

Prayers in public schools, even citing the Pledge of Allegiance is abhorrent as is the mere mention of God’s name.
Claiming that public schools exist to educate, and not to proselytize, they conveniently select their agenda.
They claim that making prayer an official part of a student’s day is considered coercive and invasive, usurping the rights of parents to instill religion as they see fit.

Yet they insist they are typifying the spirit of the First Amendment by selecting anti-Muzlim, and anti-homosexual statements to be barred, but not anti-woman or anti-religious sentiments?

And lest we forget...The purpose of the First Amendment is not to put religion in its place, but actually in a subtle way to safeguard religion..by keeping the good ole government in its place.

    Great post, Angel! I’m tired of judicial activist judges ruling against what this country was founded on, Christianity. Kids get away with all sorts of horrible, immoral things, but when a kid speaks up for his Christian beliefs, they try to take him down!

    Were the MSM not so politicized and did the job that the founding fathers assumed they would do -no judge or president would survive with this crap without a continual scolding from the press. Shame and a ruined legacy are powerful deterents for this stuff. However the MSM has abdicated its special resonsibility in this area and joined in with the destroy America party of the left. I am certain that had our forefathers anticipated this iversion of responsiblility toward the good of the country -the press would have had limits placed upon them as well as the judges.

    The conservative base needs to remind the left with its silly empeach Bush talk that a sword slices both ways by taking a few of these whacko judges down with impeachment proceedings.

    Sigh -however we all know that the real problem is with the selfish or ignorant idiots that vote in the people who put them in place.

    Well, the good news is it is the 9th circuit, which is the most overturned court in the land. The bad news is that Montana is part of the 9th circuit!!!
